Terms of Service

1. Acceptance

By creating an account, signing in, or otherwise using Scratchy Us (the “Service”), you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the Service.

2. Definitions

• “We”, “us”, and “operator” mean DJ.H (Do Jin-hyeon).
• “You” means the person who creates or uses an account.
• “Partner” means the other account paired with yours through an invite code.
• “Memories” means photos, videos, voice notes, captions, comments, and related metadata you post.

3. Service description

Scratchy Us is a private world map for two people. You can browse the map after sign-in. Scratching, posts, and albums unlock when you pair with a partner. A country opens in color only when you both scratch it. Opened countries can hold memories that only the two of you can see. The Service is free, with no in-app purchases and no ads.

Country outlines are simplified so they are easier to scratch. No other meaning is intended.

4. Eligibility

You must be at least 18 years old, and old enough to form a binding contract where you live. The Service is intended for adults using it as a couple. You are responsible for complying with the laws that apply to you.

5. Accounts

You may sign in with email and password, Google, or Sign in with Apple. You are responsible for the credentials you use and for activity on your account. Keep your invite code private; anyone who enters it can attempt to pair as your partner.

You may sign out at any time. To delete your account, follow Delete Account.

6. Couple connection and disconnection

You can browse the map after sign-in. Scratching, posts, and albums unlock when two accounts pair with an invite code. Either partner may disconnect from Profile. After disconnect, you both return to browsing without a pair. Shared memories and map progress stay stored but are no longer shown. Pairing again creates a new couple connection; previous memories are not restored in the app.

7. License to use

We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, solely for the Service. You may not copy, modify, reverse engineer, rent, or resell the app except as allowed by law.

8. Your content

You retain ownership of the memories you post. You grant us a limited license to store, process, transmit, and display that content solely so the Service can show it to you and your paired partner. We do not claim marketing or promotional rights over your private photos, videos, or voice notes.

You represent that you have the rights needed to post the content, and that it does not infringe anyone else’s rights or violate these Terms.

9. Acceptable use

You agree not to:

• Use the Service for anything illegal, harmful, or harassing.
• Post content that is illegal, sexually exploitative, or that you do not have the right to share.
• Create, share, or solicit child sexual abuse or exploitation material (CSAE). We will remove it and report confirmed CSAM to the relevant authority.
• Attempt to access another couple’s data, scrape the Service, or interfere with its security or operation.
• Impersonate someone else or misuse invite codes to pair without consent.

10. Privacy

Our Privacy Policy explains what we collect and why. By using the Service you acknowledge that Policy.

11. Third-party services

The Service uses Firebase (authentication, analytics, crash reporting, messaging, App Check), Mixpanel (product analytics), and Supabase (database and storage), and may use Google or Apple for sign-in. Their terms and privacy policies apply to their parts of the stack. We are not responsible for those third-party services.

12. Availability and changes

We may change, suspend, or discontinue features. We do not guarantee uninterrupted access. Map outlines, landmarks, and available countries may be updated over time.

13. Disclaimer of warranties

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the map is a precise geographic record.

14. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, memories, or profits, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim (which is zero while the Service is free).

15. Indemnity

You will defend and indemnify us against claims arising from your content, your misuse of the Service, or your violation of these Terms, to the extent permitted by law.

16. Suspension and termination

We may suspend or terminate access if you violate these Terms, if required by law, or if we discontinue the Service. You may stop using the Service and request deletion as described on Delete Account. Sections that by their nature should survive (including 8, 13–15, 17, and 20) will survive termination.

17. Governing law

These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-law rules, except where mandatory consumer laws in your country of residence give you additional rights that cannot be waived.

18. Changes to these terms

We may update these Terms. The effective date at the top will change when we publish a revision. Continued use after the update constitutes acceptance, except where the law requires additional consent.

20. Severability and entire agreement

If a provision is held unenforceable, the rest remains in effect. These Terms and the Privacy Policy are the entire agreement between you and us about the Service, and they replace any prior understandings on the same subject.
